Beta 0.9.0 is a test version of Hit the Lens Plugin: a program for 64-bit Windows 10 and 11 that analyses the photos of a session of the photo software named in clause 7, finds the shots where the subject looks into the lens and marks them with colour tags written to XMP files next to the photos. The result is a pre-selection to check, not a final choice. The beta is meant to gather the experience of the first users before the paid version.
The beta is free of charge: we ask for no payment and no payment details, and there are no automatic charges or renewals. It works until 31 January 2027 inclusive (end of the day, Italian time); the date is written inside the installed program, and the program warns you from 14 days before. After that date the program starts no new analyses, while undoing past analyses, the settings and creating the support file keep working; XMP files already written stay as they are. To download the beta you give us your e-mail address and the type of photography work you do, and you can choose whether to receive promotional messages. So you pay no price, but you provide personal data. If you are a consumer, the rules of the Italian Consumer Code on contracts for the supply of digital content (arts. 135-octies ff., Legislative Decree 206/2005) also apply where the consumer provides personal data instead of a price, except where the data are processed exclusively to supply the digital content or to meet legal obligations (art. 135-octies(4)). As we also use the data for purposes other than supply alone (for example statistics by type of work), we treat the beta as subject to those rules. DIGITAL INDEX grants you free of charge, for the duration of the beta, a personal, non-exclusive and non-transferable licence to install and use Hit the Lens Plugin on your computers, for personal or professional use (including your work as a photographer). The program remains the property of DIGITAL INDEX: you receive a licence to use it, not ownership. You may not:
Hit the Lens Plugin contains third-party components (including CPython, NumPy, OpenCV, MediaPipe, Pillow, rawpy and LibRaw), listed with their licences and copyright notices in the THIRD-PARTY-NOTICES.txt file in the installation folder. Those components are governed by their own licences, which may give you additional rights, and the restrictions of clause 5 do not apply to them. LibRaw is distributed under the CDDL-1.0 licence and its source code is available at https://github.com/LibRaw/LibRaw; any terms other than CDDL-1.0 relating to LibRaw are offered by DIGITAL INDEX alone, not by the LibRaw authors. The program also includes the Microsoft Visual C++ runtime components and the Intel Integrated Performance Primitives (IPP) library contained in OpenCV: as required by the Microsoft and Intel terms, you may not decompile, disassemble or modify these components or alter their copyright, trademark or patent notices.
Works with Capture One on Windows. Launch it from the Image > Open With menu in Capture One. How it works: Hit the Lens Plugin is a standalone Windows application that you launch from the Image > Open With menu in Capture One. It analyses the images of the session and writes standard XMP sidecar files; Capture One reads them with Image > Load Metadata. It does not install anything inside Capture One and does not appear in the Capture One Plugin manager. The beta works only with Capture One sessions, not with catalogs. Hit the Lens Plugin is an independent product of DIGITAL INDEX (Modena, Italy). It is not affiliated with, sponsored, authorised or endorsed by Capture One A/S. Capture One is a registered trademark of Capture One A/S in the European Union and/or other countries. All other trademarks are the property of their respective owners and are used only to identify the software with which this product is designed to work.
The beta is a test version. We tell you so expressly before the download and ask you to accept it with a separate checkbox: it may contain errors; it may mark as "looking into the lens" photos that are not, or fail to mark some that are; it may be slow or not work on some computers; it may stop working with future versions of the software named in clause 7. You expressly and separately accept these deviations from what would be expected of a final program (art. 135-undecies(4) of the Italian Consumer Code). Otherwise the program is supplied "as is", with no warranties beyond those the law does not allow to be excluded. If you are a consumer, the rights the law gives you and that no contract can exclude or limit remain unaffected (art. 135-vicies bis of the Italian Consumer Code).
The program never modifies RAW files: it writes or updates the XMP files next to the photos and, if automatic loading is on, asks the software named in clause 7 to read them again. By default it does not overwrite colour tags that are already there. Every analysis can be undone from the program: undo puts back the values that were there before that analysis and leaves alone any value you changed in the meantime. Where it can, it puts the XMP file back byte for byte as it was, using the safety copy taken before changing it; if that copy cannot be used (for instance because the file was changed after the analysis) it puts the values back by rewriting the file, and then the values are the earlier ones but the formatting of the XMP file may differ from the original. If a photo had no colour label before the analysis, undo writes the label "None" into its XMP file, the same one the software named in clause 7 writes when you clear a colour by hand: that is what makes it remove the colour from its catalogue when it reads the file again. In that case the XMP file does not come back identical byte for byte, because it carries that extra label. Before using the program, keep a backup copy of your photos, sessions and XMP files anyway: the beta can make mistakes and a backup is the only complete protection.
As the beta is free and experimental, to the extent permitted by law DIGITAL INDEX is not liable for indirect damage, loss of profit, or loss of data or work that an ordinary backup would have prevented. This limit never applies to damage caused by wilful misconduct or gross negligence, nor to breaches of obligations arising from public-policy rules (art. 1229 of the Italian Civil Code), and it does not reduce the mandatory rights of consumers. If you use the program for your professional activity, this clause and clause 8 are submitted to you for the specific approval required by arts. 1341 and 1342 of the Italian Civil Code.
You can stop using the program whenever you want and uninstall it from the Windows apps list. The program's data folders stay on the computer until you delete them (see the privacy notice). For digital content supplied without a tangible medium, where the contract does not oblige the consumer to pay, the 14-day right of withdrawal for distance contracts does not apply once supply has begun, that is from the download (art. 59(1)(o) of the Italian Consumer Code). In any case you can ask us at any time to delete your data and to stop writing to you.
Photos are analysed only on your computer and the program sends no telemetry. During the beta the program opens no network connection at all: it does not check online for new versions, and it needs neither an account nor a licence key. All details, including the data collected at download, are in the privacy notice.
An update of the beta may contain updated terms: the installer shows them to you before installing it, and they apply from when you install it. The future paid version will have a separate licence agreement. Using the beta does not oblige you to buy anything.
These terms are governed by Italian law. If you are a consumer residing in another country, this choice does not deprive you of the protection of the mandatory rules of your country of residence (art. 6(2) of Regulation (EC) No 593/2008), and the rules on the competent court that the law provides to protect consumers remain unaffected. The terms exist in Italian and English with the same structure; in case of conflict the Italian text prevails.
